1. INTRODUCTION

This Privacy and Data Collection Policy (the “Privacy Policy”) and its terms apply to the use of Sushi Ben (the “Game”), any other related products developed by Big Brane Studios, Inc. (the “Big Brane”, “we”, “our”, and their derivatives), and online services that allow for online network connectivity and interactivity (the “Online Services”).  The Privacy Policy also applies and has effect on our websites (www.bigbranestudios.com and www.sushiben.com) (the “Websites”) and when you contact us through any of the Big Brane emails (such as legal@bigbranestudios.com) or forms on the Websites. 

 

Use of the Game, its related products, and the Websites constitutes acceptance of these terms, which may be amended or changed without notice. Check this Privacy Policy from time to time to be aware of any changes.

2. Information We May Collect

We may collect a limited amount of data as necessary for gameplay features, to inform further improvements, and to provide assistance. We have no access to, nor will we ever ask for, user passwords or platform account information.

 

When Using the Game (“Basic Information”)
  • Per-platform User ID and/or Display Name;

  • Game Generated Stats;

  • Game Progress and Milestones;

  • User Settings and Preferences;

  • System Information;

  • XR Hardware Information; and

  • Performance Metrics.

 

When Using the Websites (“Website Information”)
  • Number of times you visit the Websites;

  • Which pages you go to;

  • Traffic data;

  • Your IP and MAC address; and

  • Your internet service provider.

 

When Contacting Us via Email or Forms (“Contact Information”)
  • Your name;

  • Your email address;

  • Debug logs or any other technical information that you provide; and

  • Any non-personal information/content regarding questions or requests.

3. How the Collected Information is Used

To Provide and Improve the Online Services to You

We may use Basic Information to authenticate your game entitlement and track your individual statistics along with any game progress. Processing the Basic Information also allows us to deliver features, updates, and other functions for the Game.


To Provide Technical Assistance and Improve the Game

We may use Basic Information alongside Website Information and Contact Information as a means to analyze the Game and its functionality. By processing the aforementioned information, we ensure that the Game is functioning properly while also improving the quality of the Game for players through features or updates and identifying and correcting any bugs in the Game.
 

To Respond to Inquiries and Requests

We may use the collected Contact Information to personalize our communications with you such as answering questions about or providing support for the Game. The Contact Information you provide may also be used to improve the Game while also facilitating the resolution of a request or answering any inquiry.

4. Sharing Your Data

We aim to protect your information both online and offline. The information you provide is restricted to Big Brane employees, contractors, subcontractors, and affiliates who have valid reasons to access such information to perform a service or for any other purpose outlined in this Privacy Policy.

 

As the Game is on third party platforms such as Meta, please review each platform’s privacy policies as they may differ from this Privacy Policy and how they process your information. We are not responsible for the policies on those platforms. 

 

We assure you that:

 

  • Your information will not be shared with any person or organization outside of Big Brane unless required by law (which may include government or law enforcement agencies); and

  • Your information shall not be sold or rented to third parties for advertising purposes.

 

We may share your information to the following people or organizations (which may be located in and outside your country or region):

 

  • Any member of Big Brane, our employees, contractors, subcontractors, or affiliates to carry out any purpose stated in this Privacy Policy on the basis that they do not make independent use of the information;

  • Gaming platforms on which the Game can be purchased and downloaded from such as Meta, PlayStation Network, VIVEPORT, and/or Steam for the purposes of facilitating any payments made through these platforms; and 

  • Anyone or any organization (government or law enforcement agencies) to whom we are required by law to disclose personal information (upon valid and enforceable request).

 

If we are involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via a prominent notice on our website and/or our official social media accounts of any change in ownership or uses of this information, as well as any choices you may have regarding this information.

6. Children’s Privacy

SUSHI BEN IS NOT INTENDED FOR CHILDREN

 

You must be at least the age of majority in your place of residence to play the Game. The Game is not directed to or intended for use by minors. 

 

Consistent with the requirements of the U.S. Children’s Online Privacy Protection Act of 1998, if we learn that we received any information directly from a child under age 13 without their parent’s verified consent, we will use that information only to inform the child (or their parent or legal guardian) that they cannot use the Game.

7. General Data Protection Regulation (“GDPR”)

If you are a resident of the European Economic Area (the “EEA”) or the United Kingdom (the “UK”), you may have rights under the GDPR which are outlined below. Upon exercising your rights through a request (free of charge), we will have to confirm your identity before we respond to the request.


If you are entitled to any of the following rights, then you may exercise them with respect to the personal information (as defined in the GDPR) that we collect and process:

 

  • The right to access your personal information;

  • The right to request a copy of your personal information;

  • The right to correct any inaccuracies in your personal information;

  • The right to request that we erase your personal information that we have collected;

  • The right to data portability, meaning that you can request a transfer of your personal information from us to any person or entity of your choosing;

  • The right to restrict the processing of your personal information; and

  • The right to object to the processing of your personal information.
     

These rights will be subject to any  limitations that are stated by the GDPR.

Whenever we transfer personal data out of the EEA or UK, we will ensure a similar degree of protection is afforded to it by using a solution that enables lawful transfer of personal data to a third country in accordance with Article 45 or 46 of the GDPR (including the European Commission Standard Contractual Clauses).

Right to Know and Access Your Information

You have the right to request that we disclose certain personal information about you to you regarding our collection and use of your information. You can make a request to know up to twice a year, free of charge. 

 

Once your request is received and it is confirmed that it is a verified consumer request, we will disclose the following information to you:

 

  • The categories and/or specific pieces of the information we have collected about you; 

  • The categories of sources for the information;

  • The purposes for which we use that information; 

  • The categories of third parties with whom we disclose the information; and 

  • The categories of information that we disclose to third parties. 

 

Right to Delete

You can request we delete personal information we collected from you subject to certain exceptions. Once your request is received and it is confirmed that it is a verified consumer request, we will delete the information from our records (unless an exception applies), and ask any service providers to do the same.

 

Right to opt-out of Sale or Sharing

Your personal information shall not be sold or rented to third parties for advertising purposes.

 

Right to Correct

You may ask us to correct inaccurate information that we have about you in our systems.

 

Right to Limit Use and Disclosure of Sensitive Personal Information

You can direct us to only use your sensitive personal information for limited purposes.

Big Brane will take reasonable technical and internal precautions to prevent the loss, misuse, or alteration of your personal information.

 

Although we will endeavor to provide reasonable security for the information we process and maintain, no security system can prevent all potential security breaches.
