1. Scope
This Fan Content Policy (“Policy”) governs the creation and sharing of unofficial fan content based on Sushi Ben and related intellectual property owned by Big Brane Studios, Inc. (“Big Brane,” “we,” “us,” or “our”).
We appreciate the creativity of our community and want to support fan expression within clear and reasonable guidelines. This Policy explains what kinds of fan content are permitted and what restrictions apply.
2. Definitions
2.1 “Sushi Ben IP” means all intellectual property owned or controlled by Big Brane relating to Sushi Ben, including but not limited to characters, names, locations, story elements, artwork, music, audio, video, logos, and other proprietary content.
2.2 “Fan Content” means original, unofficial content created by you that is based on or incorporates Sushi Ben IP, including but not limited to artwork, videos, livestreams, gameplay clips, and similar creative works.
3. License Grant
3.1 Subject to your compliance with this Policy, Big Brane grants you a limited, non-exclusive, revocable, non-transferable license to create and share Fan Content based on Sushi Ben IP.
3.2 This Policy does not transfer any ownership rights in Sushi Ben IP.
3.3 Big Brane may revoke this license at any time, for any reason, at its sole discretion.
4. Permitted Uses
Subject to the restrictions in this Policy, you may:
4.1 Create and share non-commercial Fan Content.
4.2 Livestream or otherwise publicly display Sushi Ben on platforms such as Twitch, YouTube, or similar services.
4.3 Upload gameplay videos, clips, recordings, or similar content to platforms such as YouTube, TikTok, Twitch, or similar services.
4.4 Monetize videos and streams only through platform-supported features such as:
- advertising revenue;
- partner program revenue;
- subscriptions; and
- donations.
4.5 Use Sushi Ben IP only in a way that makes clear that your Fan Content is unofficial and not owned, sponsored, or endorsed by Big Brane.
5. Restrictions
You may not:
5.1 Sell, license, or otherwise commercially exploit Fan Content, including physical or digital merchandise, regardless of scale.
5.2 Mass-produce, commercially distribute, or offer for sale any Fan Content that uses Sushi Ben IP.
5.3 Use crowdfunding platforms such as Kickstarter or Indiegogo to create, fund, or sell merchandise or other products based on Sushi Ben IP.
5.4 Represent Fan Content as official, licensed, approved, sponsored, or endorsed by Big Brane.
5.5 Use Sushi Ben IP in connection with content that is unlawful, defamatory, hateful, discriminatory, harassing, or otherwise harmful to individuals or groups.
5.6 Use Sushi Ben IP in a way that could reasonably damage the reputation of Sushi Ben or Big Brane, including through inappropriate, offensive, or misleading depictions.
5.7 Use Sushi Ben IP in connection with religious or political messaging or imagery.
5.8 Use Sushi Ben IP in connection with NFTs, cryptocurrencies, blockchain-based assets, or similar technologies.
6. Required Disclaimer
Fan Content must clearly and reasonably include the following disclaimer:
“This is unofficial fan content and is not affiliated with or endorsed by Big Brane Studios.”
7. Ownership
7.1 You retain ownership of your original contributions to your Fan Content.
7.2 Big Brane retains all rights, title, and interest in and to Sushi Ben IP.
7.3 By creating and sharing Fan Content, you grant Big Brane a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and share your Fan Content for promotional and business purposes.
8. Enforcement and Termination
8.1 Big Brane reserves the right to:
- request removal of Fan Content that violates this Policy;
- revoke this license at any time, for any reason; and
- take legal action where appropriate.
8.2 Failure to comply with this Policy may result in enforcement action, including requests to remove or disable access to Fan Content.
9. Changes to This Policy
We may update this Policy from time to time. Continued creation, publication, or use of Fan Content after such updates constitutes acceptance of the revised Policy.
